1. Who we are
These Terms & Conditions ("Terms") are a binding agreement between you and BOULDER MCAT ("Boulder MCAT", "we", "us", or "our"). By accessing or using our website, tutoring services, course content, or student portal (collectively, the "Service"), you agree to these Terms.
2. Eligibility and account
You must be at least 18 years old, or have parent/guardian consent, to use the Service. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.
3. The service
Boulder MCAT provides MCAT tutoring sessions, on-demand video lessons, study materials, and related educational support. We do not guarantee any particular exam score, admissions outcome, or that the Service will be uninterrupted or error-free.
4. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or abusive purpose;
- infringe the intellectual property or other rights of any third party;
- upload malware or attempt to probe, scan, or interfere with our security;
- scrape, copy, resell, or redistribute our content or course materials;
- share your account, recordings, or paid materials with anyone else.
5. Intellectual property
All content provided through the Service — including video lessons, written materials, course structure, branding, and software — is owned by Boulder MCAT or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal MCAT preparation only.
6. Payments, billing, and subscriptions
Payments are processed by our payment provider Stripe. By completing a purchase you also agree to Stripe's terms, available at stripe.com/legal/consumer. Applicable sales tax is calculated and collected at checkout where required. For cancellations and refunds, please review our Refund Policy.
7. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability) will survive.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, Boulder MCAT disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not provide medical, legal, or admissions advice.
9. Limitation of liability
To the fullest extent permitted by law, Boulder MCAT will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
10. Governing law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Boulder County, Colorado will have exclusive jurisdiction over any disputes.
11. Changes to these terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
